What Are the Penalties for Drug Trafficking in Florida?

You need to know what you’re up against—drug trafficking in Florida is a First degree felony, which means you could easily expect to spend at least one year in prison if convicted.

As with any drug crime, the type of drug and amount determine the consequences:

  • 3 years in prison and $25,000 in fines for up to 2,000 pounds of marijuana
  • 7 years in prison and $50,000 in fines for 2,000-10,000 pounds of marijuana
  • 3 years in prison and $25,000 in fines for 28 to 200 grams of cocaine
  • 3 years in prison and $50,000 in fines for 4 to 14 grams of heroin

Even though judges have some discretion when it comes to sentencing, there are still state minimums for prison time which are defined by statute. Further, your sentences could be enhanced if your offense took place in or near a school or other protected zone.
