What Are the Penalties for Drug Trafficking in Florida?

Selling, purchasing, manufacturing, delivering, or bringing illegal substances into Florida can get you arrested for drug trafficking; a conviction for which can ruin your future. You need to take these accusations seriously and take steps to protect yourself. This begins with retaining a skilled Miami drug crime attorney who can fight for your rights in and out of court.

You need to know what you’re up against—drug trafficking in Florida is a First degree felony, which means you could easily expect to spend at least one year in prison if convicted.

As with any drug crime, the type of drug and amount determine the consequences:

  • 3 years in prison and $25,000 in fines for up to 2,000 pounds of marijuana
  • 7 years in prison and $50,000 in fines for 2,000-10,000 pounds of marijuana
  • 3 years in prison and $25,000 in fines for 28 to 200 grams of cocaine
  • 3 years in prison and $50,000 in fines for 4 to 14 grams of heroin

Even though judges have some discretion when it comes to sentencing, there are still state minimums for prison time which are defined by statute. Further, your sentences could be enhanced if your offense took place in or near a school or other protected zone.

Experienced Trafficking Legal Counsel with Rothman & Associates, P.A.

Our Miami criminal defense lawyer can use all the tools at their disposal to protect you from a conviction. A common drug defense is that your Fourth Amendment rights were violated in some way. Police are required to follow the law, too, when they stop you or search you, your vehicle, or your home or your charges could be dropped.

Sometimes, prosecutors aren’t even able to produce the drugs you are accused of trafficking as a result of the many hands through which they may have passed since your arrest. No matter the specifics of your charge, our firm is ready to protect your future.
